Terms of Service — Supra-Works

Welcome to Supra-Works (“Supra-Works,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of our website and online store (the “Site”) and any purchases made through the Site. Our store is hosted on Shopify.

Important legal notice: By using the Site or purchasing from us, you agree to these Terms and all policies referenced here (including our Shipping Policy, Refund Policy, and Privacy Policy, if posted). If you do not agree, do not use the Site.

1) Eligibility and Use

You must be at least the age of majority where you live (or have permission from a parent/guardian) to use the Site. You agree not to use the Site for any unlawful purpose, to violate any laws, or to interfere with Site security or operations.

2) Orders, Acceptance, and Cancellations

Placing an order is an offer to purchase. We may accept, refuse, limit, or cancel any order at our discretion, including for suspected fraud, unauthorized activity, pricing/description errors, inventory issues, or misuse of promotions. If we cancel after payment, we will refund the amount paid to the original payment method.

3) Prices, Taxes, and Payment

Prices are listed in [USD] unless stated otherwise and may change at any time. Taxes and shipping charges are calculated at checkout where applicable. By submitting payment information, you represent you are authorized to use the payment method and you authorize us (and our payment processors) to charge your payment method for the total amount of your order.

4) Shipping, Delivery, and Risk of Loss

Shipping timelines are estimates, not guarantees. Title and risk of loss pass to you once the shipment is transferred to the carrier, to the maximum extent permitted by law. Please ensure your address is correct—costs related to returned, reshipped, or re-routed packages due to incorrect addresses may be your responsibility.

5) Returns, Refunds, and Exchanges

Returns and refunds are governed by our Refund Policy. Some items may be final sale or not eligible for returns for hygiene, customization, clearance, or other reasons disclosed at purchase. We may require proof of purchase and/or photos for damaged/incorrect items.

6) Product Use, Assumption of Risk, and No Professional Advice

Our products, content, and communications are provided for general informational purposes only and are not professional advice (including mechanical, safety, legal, or other advice). You are solely responsible for the proper selection, installation, use, and maintenance of any products purchased from Supra-Works.

Assumption of risk: You acknowledge that certain products may involve inherent risks if used improperly. You agree to use products safely and according to any instructions or warnings provided.

7) Disclaimers (No Warranties)

To the fullest extent permitted by law, the Site and all products are provided “as is” and “as available” without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising out of course of dealing or usage of trade. Some jurisdictions do not allow certain warranty disclaimers, so some of these disclaimers may not apply to you.

8) Limitation of Liability (Key Protection)

To the fullest extent permitted by law:

Supra-Works, Owner's, Individuals associated Supra-Works, will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost revenue, lost savings, loss of data, or business interruption, arising from or related to the Site, your purchase, or your use/misuse of any product.
In all cases, Supra-Works’ total liability for any claim will not exceed the amount you paid for the product(s) giving rise to the claim during the [12] months before the event giving rise to liability (or $100, whichever is greater), unless a higher minimum is required by law.

9) Indemnification

You agree to defend, indemnify, and hold harmless Supra-Works (including the owner/operator) from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your breach of these Terms; (b) your misuse of the Site or products; (c) your violation of any law; or (d) your infringement of any third-party rights.

10) Chargebacks, Fraud, and Abuse

We may dispute chargebacks and provide order records (delivery confirmation, tracking, communications) to payment processors. We reserve the right to block future purchases and/or require signature confirmation for orders associated with suspected fraud, excessive chargebacks, or abusive conduct.

11) Intellectual Property

All Site content (logos, product names, designs, images, text, graphics, and software) is owned by or licensed to Supra-Works and protected by intellectual property laws. You may not copy, reproduce, distribute, or create derivative works without our prior written permission.

12) User Content (Reviews, Photos, Submissions)

If you post or submit content (reviews, images, videos, text), you grant Supra-Works a non-exclusive, worldwide, royalty-free, sublicensable license to use, reproduce, modify, publish, and display that content for business and marketing purposes. You represent you own or have permission to submit it and that it does not violate third-party rights or laws. We may remove content at our discretion.

13) Third-Party Services and Links

The Site may rely on third-party services (payments, shipping carriers, apps, analytics) or include links to third-party websites. We are not responsible for third-party services, content, or policies. Your use of third-party services is subject to their terms.

14) Termination

We may suspend or terminate access to the Site at any time for suspected fraud, abuse, or violation of these Terms. Sections that should survive termination will survive, including Disclaimers, Limitation of Liability, Indemnification, and Governing Law.

15) Governing Law and Venue

Arbitration / class action waiver (optional): If you want, I can add an arbitration clause and class-action waiver tailored to your state (this can add protection, but it must be drafted carefully to remain enforceable).

We may update these Terms at any time. The “Last updated” date reflects changes. Continued use of the Site after updates means you accept the revised Terms.
